HCBS Final Rule Compliance Information - Survey Results as of April 30, 2022

As part of the Department of Developmental Service’s (DDS) efforts to meet requirements of the Home and Community-Based Services Final Rule, all eligible day, employment and residential service providers were required to complete a self-assessment by August 31, 2020.  The self-assessment allowed the vendor to measure their current level of compliance with the HCBS Final Rule.

As part of the Department of Developmental Service’s (DDS) efforts to meet requirements of the Home and Community-Based Services Final Rule, all eligible day, employment and residential service providers were required to complete a self-assessment by August 31, 20201.  The self-assessment allowed the vendor to measure their current level of compliance with the HCBS Final Rule.

Home and Community Based Services (HCBS) Compliance Funding Availability for Service Providers for 2021-2022 –
 Deadline: November 12, 2021

On January 13, 2021, DDS announced the Compliance Funding for fiscal year 2021-2022 to assist service providers to come into compliance with the Home and Community Based Services Final Rule.  

In recognition that some service providers need to take steps towards modifying their services to come into compliance with the HCBS rules by March 2023, the 2020 enacted budget contains $15 million to fund necessary changes. Below is the link to view a copy of the Department of Developmental Services’ (Department) Fiscal Year 2021-2022 HCBS Provider Compliance Funding Guidelines and the letter regarding the funding for compliance activities for service providers who wish to apply for funding.

The Department will hold two, one-hour webinars to review the funding application process and answer questions. The webinars will be held on Wednesday, October 6, 2021, from 1:00 p.m - 2:00 p.m.. and Friday, October 8, 2021 from 11:00 a.m. - 12:00 p.m.

DDS Announcement of Approved HCBS Provider Funding Concepts for FY 2020-21

On May 4, 2021 DDS announced the concept/proposals, that were submitted by service providers, that have been selected for funding.  For fiscal year 2020-2021, the California legislature allocated $15 million for service providers to make changes to their services in order to meet the requirements of the federal Centers for Medicare and Medicare (CMS) Home and Community Based Services (HCBS) final regulations or rules.  DDS received 296 requests for funding from service providers statewide and has selected 172 concepts for funding.  SG/PRC service providers submitted 18 concepts and 9 were selected for funding.

Implementation Date for HCBS Settings Rule

The Center for Medicaid and Medicare Services (CMS) has released an announcement indicating a delay in the implementation date for Home and Community Based Services (HCBS) Settings Rule compliance until 2023. CLICK HERE FOR MORE INFORMATION

HCBS Self-Assessment Trainings 

The Department of Developmental Services, in partnership with Public Consulting Group, is offering training opportunities on the Home and Community-Based Services (HCBS) Settings Self-Assessment Process. 

There will be 5 in-person trainings with webinar access available to service providers. This training will focus on the expectation for completing the required self-assessment, walking through the intent of the questions, and strategies to ensure input from individuals served and their families are included throughout. One of these trainings will be offered at San Gabriel/Pomona Regional Center.

In addition, SG/PRC will be offering hands-on technical assistance to assist providers with completing the survey.  This assistance will be provided on Thursday mornings from 9:30 to 12 noon beginning February 27, 2020. Please contact Lourdes Sanchez to sign up at 909-706-3574. 

Service Providers vendored where the service is designed specifically for groups of individuals with developmental disabilities, are required to complete a self-assessment. 


HCBS Self- Assessment - Required Electronic Submission

The Department of Development Services has informed the Regional Centers that providers of some regional center services will be required to complete a self-assessment to measure their current level of compliance with the HCBS Final Rule by June 30, 2020  The self-assessment will be available through an online platform developed by a contracted company, OIG Compliance Now. A unique login will be provided to vendored providers via email from OIG Compliance Now. Although training will be offered on how to complete the selfassessment, providers can begin the assessment upon receiving their login information.

On May 11, 2020 DDS announced the concept/proposals, that were submitted by service providers, that have been selected for funding.  For fiscal year 2019-2020, the California legislature allocated $15 million for service providers to make changes to their services in order to meet the requirements of the federal Centers for Medicare and Medicare (CMS) Home and Community Based Services (HCBS) final regulations or rules.  DDS received 240 requests for funding from service providers statewide and has selected 160 concepts for funding.  SG/PRC service providers submitted 11 concepts and 11 were selected for funding.

Deadline November 22, 2019

On October 17, 2019, DDS announced the Compliance Funding for fiscal year 2019-2020 to assist service providers to come into compliance with the Home and Community Based Services Final Rule.  

In recognition that some service providers need to take steps towards modifying their services to come into compliance with the HCBS rules by March 2022, the 2019 enacted budget contains $15 million to fund necessary changes. DDS Announcement of Approved HCBS Provider Funding Concepts for FY 2018-19

On May 7, 2019, DDS announced the concepts/proposals, that were submitted by service providers, that have been selected for funding. For fiscal year 2018-19, the California legislature allocated $15 million for service providers to make changes to their services in order to meet the requirements of the federal Centers for Medicare and Medicaid (CMS) Home and Community Based Services (HCBS) final regulations, or rules. DDS received 316 proposals from service providers statewide and has selected 187 concepts for funding. SG/PRC service providers submitted 17 concepts and 10 were selected for funding.

Home and Community Based Services (HCBS) Compliance Funding Availability for Service Providers for 2018-19 - Deadline December 14, 2018

The California 2018 Budget Act once again includes funding to assist service providers seeking to come into compliance with the Home and Community Based Services Final Rule. The federal Centers for Medicare and Medicaid Services (CMS) established the HCBS Final Rule in March 2014[1]. Compliance with these new rules is required by March 2022. Recognizing the scope of changes required to be made in the system, to be in full compliance, the State of California has made funding, in the total amount of $15 million statewide, available for service providers to submit proposals regarding changes they will make to their services to be in compliance with these federal rules.

DDS Announcement of Approved HCBS Provider Funding Concepts for FY 2017-18

On May 4, 2018 DDS announced the concepts/proposals, that were submitted by service providers, that have been selected for funding. For fiscal year 2017-18, the California legislature allocated $15 million for service providers to make changes to their services in order to meet the requirements of the federal Centers for Medicare and Medicaid (CMS) Home and Community Based Services (HCBS) final regulations, or rules. DDS received 310 proposals from service providers statewide and has selected 134 concepts for funding. SG/PRC service providers submitted 19 concepts and 11 were selected for funding.

Home and Community Based Services (HCBS) Compliance Funding Availability for Service Providers for 2017-18 - Deadline January 5, 2018

DDS has provided correspondence to the regional centers about the process for service providers to access this compliance funding in 2017-18. This correspondence can be found on the DDS website at: http://www.dds.ca.gov/hcbs/. A deadline of January 5, 2018 has been established by DDS for eligible service providers to submit proposals/concept papers to their vendoring regional center. Additionally, DDS has scheduled a series of webinars for interested parties to review the process and answer questions.


Extension of Transition Period for Compliance with Home and Community-Based Settings Criteria to March 2022

 

In recognition of the significance of the reform efforts underway, CMS intends to continue to work with states on their transition plans for settings that were operating before March 17, 2014 to enable states to achieve compliance with the settings criteria beyond 2019.

Consistent with the preamble language, states should continue progress in assessing existing operations and identifying milestones for compliance that result in final Statewide Transition Plan approval by March 17, 2019. However, in light of the difficult and complex nature of this task, we will extend the transition period for states to demonstrate compliance with the home and community-based settings criteria until March 17, 2022 for settings in which a transition period applies. We anticipate that this additional three years will be helpful to states to ensure compliance activities are collaborative, transparent and timely.

DDS Announcement regarding CMS Compliance Funding for FY 2016-2017

In an April 25, 2017 memo, DDS announced the approved provider concepts/proposals that were selected for CMS Compliance funding. For fiscal year 2016-17, the California legislature allocated $15 million for service providers to make changes to their services in order to meet the requirements of the federal Centers for Medicare and Medicaid (CMS)  Home and Community Based Services (HCBS) final regulations, or rules. DDS received close to 900 proposals and ultimately awarded funding to 108 concepts. Of the 71 proposals submitted by SG/PRC vendors, 6 concepts were selected for funding.

SG/PRC Program Evaluator - New CMS Resource

As you may be aware, there have been significant changes enacted at the federal level which have an impact on how services are to be delivered in California. In January 2014 the Centers for Medicare and Medicaid Services (CMS) adopted new regulations. These regulations, which are often referred to as the Home and Community Based Services (HCBS) Final Rule, must be fully implemented by March 2019, in order for California to continue to receive federal funds for the services that you provide.

 Among some of the expectations, of the final rule, is for clients to be afforded the same opportunities for community integration as any other member of society. Clients must be able to pursue competitive integrated employment. If living in a licensed setting, they will have the choice to have a private bedroom and to lock their room and have a key. Clients in licensed residential homes also need to be afforded the same protections through a residential lease as any other member in the community. Clients will be allowed to have visitors at anytime and leave and return to their home as they wish. Also the person centered plan must reflect the needs and desires of the client and be directed first and foremost by the client. CMS/HCBS Overview

 Background: In January 2014, the deferral Centers for Medicare and Medicaid Services (CMS) published final rules defining what constitutes a home and community-based setting for Medicaid reimbursement purposes under Section 1915 (c) Home and Community-Based Services (HCBS) waivers, Section 1915(i) HCBS State Plan programs, and Section 1915(K) Community First Choice State Plan Options.  The effective date of the regulations is March 17, 2014.

CMS spent several years developing the final regulations through its rule making process, compiling and analyzing numerous comments from consumers, advocates, provider, state and local government agencies and the public.  The final regulations provide guidance about the qualities that make a setting home and community-based, rather than focusing on what settings are institutional in nature.  Click here to read complete CMS/HCBS Overview
