State Minimum Wage Increase - Effective January 1, 2018
Effective January 1, 2018, due to the implementation of Senate Bill (SB) 3, the minimum wage in California will increase to $11.00 per hour for employers with 26 or more employees and $10.50 per hour for employers with 25 or less employees.

Important change in the law for Respite Services
We want to inform you about an important change in the law for respite services. The law currently states that regional centers cannot purchase more than 90 hours per quarter of in-home respite and cannot purchase more than 21 days of out-of-home respite for a family, unless an exemption is granted

ABX2-1 Rate Increase Survey
ABX2-1 Finalized Survey for Provider Rate Increases – Deadline to Complete Survey is October 1, 2017 As part of the ABX2-1 rate increases, that service providers received on July 1, 2016, the Welfare and Institutions Code (WIC) section 4691.10 (b)(4) requires DDS to survey all the providers who received the increase in order to determine how the rate increase was administered by service providers. Per a DDS memo dated July 17, 2017, DDS has finalized the Survey for Provider Rate Increases. This survey is being administered online and all service providers are expected to complete the survey on or before October 1, 2017.

Change in Effect Date for 5.82 Percent Rate Increase
New federal regulations (Fair Labor Standards Act) in 2015, resulted in a 5.82% rate increase effective December 1, 2015, for service providers in the categories of Supported Living Services (SLS; service code 896), Personal Assistance (service code 062) and In-Home Respite Agencies (service code 862).

Local Minimum Wage Ordinance - Rate Adjustment Options
Effective July 1, 2017, the County of Los Angeles enacted a minimum wage ordinance which increases the minimum wage in the unincorporated areas of L.A. County to $12.00 per hour for employers with 26 or more employees and $10.50 for employers with 25 or less employees. The City of Pasadena has adopted a similar ordinance which also became effective 7/1/17. Service providers who have staff providing services in these areas, and who are paid minimum wage are expected to comply with this ordinance.

**NEW** DDS Announcement regarding CMS Compliance Funding
In an April 25, 2017 memo, DDS announced the provider concepts/proposals that were selected for CMS Compliance funding. For fiscal year 2016-17, the California legislature allocated $15 million for service providers to make changes to their services in order to meet the requirements of the federal Centers for Medicare and Medicaid (CMS) Home and Community Based Services (HCBS) final regulations, or rules.

ABX2-1 Draft Survey for Provider Rate Increases / Webinars and Feedback
On July 1, 2016, service providers of selected categories received rate increases as a result of enactment Assembly Bill (AB) X2-1. As part of this rate increase, the statute (Welfare and Institutions Code 4691.10 (b)(4)) requires the Department of Developmental Services (DDS) to survey all providers who received the rate increase in order to determine how the rate increase was used.

State Minimum Wage Increase
Effective January 2, 2017, due to the implementation of Senate Bill (SB) 3, the minimum wage in California will increase from $10.00 to $10.50 per hour for employers with 26 or more employees. As authorized by the 2016 State budget and the 2016 changes to the Welfare and Institutions Code (WIC) sections 4681.6(b), 4691.6(f) and (g), and 4691.9(b), many vendors will either receive, or be eligible to request, a rate increase if necessary to adjust employees’ pay to comply with the new minimum wage.

Request for Proposals (RFP): FY 2016-2017 ABX2-1 Funding: Proposals to Promote Equity and Reduce Disparities in Purchase of Services (POS) The Department of Developmental Services (DDS) has approved SG/PRC to receive funds for three (3) ABX2-1 equity proposals that exceeded $100,000.00: In accordance with the SG/PRC Board-approved policy, a Request for Proposal (RFP) process shall be used to solicit applicants for each development or project that has a budget in excess of $100,000.00.

POS Expenditure Reports -Utilization Memo December 2016
Each year, the regional center is required to review the utilization of POS funded services and identify any issues or trends related to the under-utilization of these services. This review includes considering all factors that would affect a client or family in utilizing or not utilizing a service, including SG/PRC’s communication with clients and families about available services, but also vendor-related reasons......

Notice to Service Providers re: AB 1606
Attention Service Providers of Crisis Intervention Facility (service code 090), Residential Services (905, 910, 915, 920, 113), Supported Living Services (896), Long-Term Health Care Facilities (925, 930, 935, 114) and Acute Psychiatric Hospitals (700). Developmental Services Trailer Bill, Assembly Bill (AB) 1606 was enacted on June 27, 2016. AB 1606 amends Welfare and Institutions Code (WIC) 4659.2 (b) which expands the special incident reporting responsibilities of the aforementioned service categories and requires these service categories to report specific incidents to Disability Rights California (per WIC 4900 (i)).

Statewide Transition Plan for CMS/HCBS Final Rule
The California Department of Health Care Services (DHCS) is developing a revised Statewide Transition Plan (STP) that will be submitted to the Centers for Medicare & Medicaid Services (CMS) in October 2016. The STP describes how the State will come into compliance with new Federal Home and Community-Based (HCB) Settings Final Rule.
